HOW TO APPLY FOR BENEFITS AT THE DEPARTMENT OF MILITARY VETERANS

These benefits are available to all military veterans from both the statutory and non-statutory forces if they qualify in terms of the different means tests for each benefit, because the Military Veterans Act, 2011 (No 18 of 2011) stipulates clearly in the definition of “military veteran” that the military veterans from the statutory forces are included

There are very specific steps which must be followed before you can approach the Department of Military Veterans to make application for the benefits that are available to the military veterans who qualify for it, and if you do not follow these steps you will not be successful with your application

If a military veteran has been convicted of rape, murder, robbery, theft or high treason committed after 27 April 1994 and was sentenced to imprisonment for a period exceeding 5 years without the option of a fine he or she is disqualified from receiving any benefits provided for in the Military Veterans Act, 2011 (No. 18 of 2011) and its regulations


What must you do before you make application for these benefits?

These benefits for military veterans as prescribed in the Military Veterans Act, 2011 (No. 18 of 2011) as well as the regulations promulgated thereto are only for those military veterans from the statutory and non-statutory forces who:

  1. have registered as military veterans with the Department of Military Veterans,
  2. have verified that their names appear on the National Database for Military Veterans,
  3. qualify for these benefits in terms of the prescribed means tests for each benefit, in other words they are in need of these benefits and are not in a position to readily provide these benefits for themselves from their own resources

If you do not qualify in terms of the current means test for these benefits, we still urge you to register on the National Database for Military Veterans and proceed to verify that your name appears on it. This is not an easy process, and the sooner you start with this process the better

Your personal circumstances may change in the future to such an extent that you may then very well qualify in terms of the different means test for these benefits, and then at least you know that your basic paperwork is in place already and you only then need to apply for these benefits.


How does one qualify for these benefits?

There are 9 benefits available to military veterans and each has a different means test to check who qualifies for it.

– Compensation for injury, trauma and disease

If a military veteran sustained disabling injuries or severe psychological and neuro-psychiatric trauma or if he or she suffers from a terminal disease resulting from participation in military activities, then he or she may apply for a lump sum payment of compensation if the disabling injury, the severe psychological and neuro-psychiatric trauma or the terminal disease resulted from the military veteran’s participation in military activities and:

  • the effect of such disability, trauma or disease is an ongoing event;
  • the medical assessment of the military veteran confirms the link between the injury, trauma or disease and his or her participation in a military activity; and
  • the military veteran has not accessed or received a similar benefit in terms of any other legislation

The medical assessment must be conducted at a public health care facility, but may also be conducted at a private health care facility when a public health care facility is unable to conduct the medical assessment services or a private health care facility is the only facility accessible in the area  READ MORE  in Regulations 3, 4 and 5 of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette 

If you as a military veteran want to access this benefit you must complete the appropriate application form, which form can be requested directly from DMV or via the CMVO office.  This form need to be completed and submitted together with the relevant documents.

Please note that this application form is in the form of an affidavit which must be signed by the military veteran or his dependants in front of a Commissioner of Oaths

The Department of Military Veterans will use the medical or other adequate assessment report to determine in accordance with the Military Pensions Act, 1976 (No 84 of 1976) what amount must be paid to a military veteran who qualifies for this compensation, where after the Minister of Military Veterans  must approve the amount of the lump sum compensation

This lump sum must be paid to the veteran within 3 months from date of approval by the Minister of Military Veterans, and if the military veteran has died after submitting his or her application but before payment was received, this lump sum will be paid to his or her deceased estate


– Counselling and treatment for mental illness and post-traumatic stress disorder

A military veteran or his or her dependant qualifies for dedicated counselling and treatment for serious mental illness or post-traumatic stress disorder if the mental illness or post-traumatic stress disorder was caused by his or her participation in military activities or is associated with his or her participation therein

The dedicated counselling and treatment for serious mental illness or post-traumatic stress disorder must be conducted at a public health care facility, but may also be conducted at a private health care facility when a public health care facility is unable to conduct the counselling and treatment or a private health care facility is the only facility accessible in the area READ MORE  in Regulations 8 and 9 of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette

If you as a military veteran or your dependants want to access this benefit you must complete the appropriate columns of the appropriate application form, which form can be requested directly from DMV or via the CMVO office.  This form need to be completed and submitted together with the relevant documents.

Please note that this application form is in the form of an affidavit which must be signed by the military veteran or his dependants in front of a Commissioner of Oaths

If a military veteran or his or her dependant is not able to apply personally for this counselling and treatment

  • any person acting on behalf of or in the interest of the military veteran or dependant;
  • any person acting in the public interest; or
  • an association acting in the interests of its members

may on behalf of that military veteran or dependant apply for such counselling or treatment


– Facilitation of employment placement

If a military veteran is unemployed and his or her name appears on the National Database for Military Veterans, that military veteran will qualify for facilitation of employment placement by the Department of Military Veterans READ MORE  in Regulations 8 and 9 of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette

If you as a military veteran want to access this benefit you must complete the appropriate application form, which form can be requested directly from DMV or via the CMVO office.  This form need to be completed and submitted together with the relevant documents.

– Facilitation of business opportunities

All existing and potential military business entities that are partially or wholly owned by military veterans and that are benefiting military veterans qualify for the  facilitation of business opportunities  READ MORE  in Regulation 10  of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette

If you as a military veteran want to access this benefit you must register your military veterans business entity on the Military Veterans Business Entity Register at the Department of Military Veterans

The Minister of Military Veterans must also establish a business vehicle through which business opportunities can be pursued by the State on behalf of all military veterans


– Business facilitation programmes

This relate to programmes by the Department of Military Veterans which may include:

  • training on business information and statistics in the various sectors
  • training on planning, logistics and financial modelling
  • information on funding and institutional arrangements
  • linkages to markets
  • skills transfer, capacity building, support and mentorship

– Subsidised public transport

A military veteran qualifies for a public transport subsidy if he or she:

  • Is not employed and receives a pension from the State
  • Is employed and has an annual income of less than R125 000

If a military veteran is not employed and he or she receives a State pension, he or she qualifies for a 100% transport subsidy when using public transport within the Republic READ MORE  in Regulation 12  of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette

The Department of Military Veterans may issue an appropriate card or voucher to qualifying military veterans to access the public transport

– Access to health care

A military veteran qualifies for health care services at the expense of the State at a public or private health care facility in the Republic if he or she:

  • Is not employed and receives a pension from the State; or
  • Is employed but - does not qualify for a medical aid subsidy from his employer, or the military veteran’s medical aid cover is not sufficient owing to the status of his or her health

These health care services must be conducted at a public health care facility, but may also be conducted at a private health care facility when a public health care facility is unable to conduct the health care services or a private health care facility is the only facility accessible in the area READ MORE  in Regulation 13  of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette Gazette

– Housing

A military veteran qualifies for a housing benefit of a total value not exceeding R175 000 if he or she:

  • Is not employed and receives a pension from the State; or
  • Is employed and has an annual income of less than R125 000

and

  • Does not own a house
  • Has not previously received a house or other housing benefit from the State; or
  •  If he or she  is in a spousal relationship, his or her spouse has not received a house or other housing benefit from the State

If a military veteran already owns a house and the total sum of the balance of the mortgage loan registered in his or her name at a registered financial institution is equal to or less than the abovementioned housing benefit the Department of Military Veterans may settle the outstanding balance of the mortgage loan with that financial institution READ MORE  in Regulations 14  and 15 of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette Gazette

– Burial support

A military veteran qualifies for burial support at the expense of the State if he or she at the time of his or her death:

  • Was not employed and received a pension from the State
  • Was employed and had an annual income of less than R125 000

and was listed as a military veteran on the National Database for Military Veterans

The Department of Military Veterans may provide burial support for a military veteran who was not listed on the National Database for Military Veterans provided that documentary evidence is provided that he or she would have qualified to be listed on National Database for Military Veteran had he or she registered before his or her death READ MORE  in Regulations 16  17 and 18 of the Military Veterans Benefits Regulations published on 19 February 2014 in the Government Gazette Gazette

The amount for burial support payable to a military veteran is R25 000. If a person applies to the Department of Military Veterans for the reimbursement of burial costs, proof must be submitted of the actual burial costs incurred
